1. General

By using this website or placing an order you agree to these terms and to our privacy policy.

2. Custom products

Everything we sell is produced to customer specifications: artwork, logo placement, sizing, materials and other options. There is no stock line.

Unless required by law, no product is eligible for return or exchange. Where there is a confirmed defect or production error, or the item does not match the proof you approved, the remedy is a replacement or a refund, claimed within 7 days of receiving your order. See returns and damages.

3. Who can order

You must be the age of majority in your state to place an order. When you order you agree that the information you give us is accurate and complete.

4. Pricing and payment

Prices can change without notice. The price confirmed on your quote or at checkout is the price you will be charged, plus any applicable sales tax. We ship inside the United States and we clear customs on the inbound freight ourselves, so import duties are ours and never yours. We may correct an error in a price, a description or an availability at any time, including after an order is placed. Where a correction changes what you pay, we tell you before anything goes into production and you can cancel.

5. Artwork and approvals

Customers are responsible for providing accurate artwork and instructions. Where proofs are provided, the customer must review and approve them before production. Once approved, changes may not be possible and may require additional cost and time.

6. Production and shipping

Production and shipping timelines vary by product, quantity, destination and customization. Dates and estimates are provided for planning and are not guaranteed unless confirmed in writing.

7. Order issues

If you believe there is an issue with your order, contact us promptly with your order number and details so we can review it. Where the fault is ours the remedy is a replacement or a refund, full or partial, depending on what went wrong.

8. Limitation of liability

To the maximum extent permitted by law, PromoMogul is not liable for indirect, incidental, special or consequential damages, including loss of profits, business interruption, or delays outside of our reasonable control.

Except where your state does not allow it, the replacement or refund described in section 2 is your only remedy, and our total liability for an order is limited to the amount you paid for that order.

9. Use of the website

You agree not to misuse the website, attempt unauthorized access, or interfere with its operation, security or availability.

10. Intellectual property

The text, photography, layout and design on this website belong to PromoMogul or to the people who licensed them to us. Please do not copy, resell or redistribute them without our written permission.

Your artwork stays yours. By sending us a logo, a design or any other file, you confirm that you own it or have permission to use it, and you give us permission to reproduce it on the goods you ordered and to keep it on file so you can reorder without sending it again. You agree to cover us against any claim that the artwork you supplied infringes someone else's rights. We do not check artwork for trademark or copyright ownership, and we may decline any job we believe we have no right to print.

11. Warranties

Beyond the remedy set out in returns and damages, and anything your state gives you that cannot be waived, this website and the products are provided as is and with all faults. We disclaim all implied warranties, including the implied warranty of merchantability and the implied warranty of fitness for a particular purpose. We do not guarantee that the website will be uninterrupted or error free, and colors can vary between a screen and a printed product.

12. Links and third-party tools

Where we link to another website or service we do not control it and we are not responsible for its content, its accuracy or its terms. Read their terms before you use them.

13. Governing law and the rest

These terms are governed by the laws of the State of Nevada, where PromoMogul is registered. Any dispute is brought only in the state or federal courts sitting in Clark County, Nevada, and we each agree those courts have jurisdiction over us. Any claim about an order must be filed within one year of the date that order was placed. If any single provision turns out to be unenforceable, the rest stays in force. Together with the policies linked from this page, these terms are the whole agreement between us about the website and your order, and they replace anything discussed beforehand.

We can end access to the website for anyone who misuses it. You remain responsible for any order already placed.

14. Updates

We may update these terms from time to time. The version that governs your order is the one published on the day you placed it, so a later change does not rewrite an order we are already producing. Continued use of the website after an update means you accept the updated terms.
